General Terms and Conditions

Section 1 Scope, Purpose of the Contract
These General Terms and Conditions apply to the business relationship between the customer and Kathrin Schröder (hereinafter: Miom Studio) when using the services, products and deliveries offered on the website.

Section 2 Conclusion of Contract
By clicking the “Buy” button, the customer submits a binding offer to purchase the products in the shopping cart after accepting these General Terms and Conditions. The contract is concluded as soon as the customer receives the order confirmation from Miom Studio via email.

Section 3 Product Specifications
(1) Information provided by Miom Studio regarding product specifications (e.g., paper quality, print quality, color, weight, dimensions, design) is approximate unless exact conformity is necessary for the intended use of the goods. This information is not a guarantee of quality but serves to describe the goods.

(2) Provided that the usability for the contractually intended purpose is not impaired, customary deviations from the stated product specifications due to fluctuations in material procurement or the production process are permissible. Many items in the product range are handcrafted, so even minor deviations between identical items are considered to be in accordance with the contract.

(3) Supplied paper intended for printing is suitable for laser and inkjet printers, unless otherwise stated in the product description.

Section 4 Product Availability
(1) If an ordered item is permanently unavailable, Miom Studio may withdraw from the contract for this reason. Miom Studio will refund any payments made immediately.

(2) In the event of a delivery delay of more than two weeks beyond the stated latest delivery date, both parties have the right to withdraw from the contract. Miom Studio will refund any payments made immediately.

Section 5 Prices and Shipping Costs
(1) Miom Studio ships the purchased goods to the delivery address specified by the customer within the EU. Shipping is handled by a service provider (e.g., DHL or Hermes).

(2) The prices quoted include statutory VAT.

(3) The customer bears the shipping costs specified in the order form.

Section 6 Payment
(1) Payment is made at the customer's discretion via one of the offered payment methods.

(2) Miom Studio's claim for payment of the purchase price and shipping costs is due immediately and without deduction upon conclusion of the contract. The ordered goods will be shipped after full payment of the purchase price and shipping costs.

(3) Miom Studio may use the services of trusted third parties to process payments. If a third party is involved in payment processing, payment to Miom Studio is considered complete as soon as the amount has been made available to the third party in accordance with the contract, such that the third party has unrestricted access to it.

(4) If the purchase price and shipping costs are not received by Miom Studio during proper payment processing (e.g., due to incorrect information provided by the customer or insufficient funds in the account), the customer shall reimburse Miom Studio or the third party commissioned by Miom Studio for any additional costs incurred.

Section 7 Warranty for Defects, Guarantee
(1) The statutory warranty rights apply.

(2) Beyond the statutory liability for defects, Miom Studio assumes no guarantee unless Miom Studio expressly provides a guarantee with the order confirmation.

(3) If the customer returns defective goods, Miom Studio shall bear the return shipping costs.

Section 8 Liability
(1) The customer's claims for damages are excluded. This exclusion does not apply to claims for damages by the customer due to injury to life, body, or health, or due to breach of essential contractual obligations, nor to liability for other damages resulting from an intentional or grossly negligent breach of duty by Miom Studio, its legal representatives, or its vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

(2) In the event of a breach of essential contractual obligations, Miom Studio shall only be liable for the foreseeable damages typical for this type of contract if such damages were caused by simple negligence, unless the customer's claims for damages arise from injury to life, body, or health.

(3) The limitations in paragraphs 1 and 2 shall also apply to the benefit of Miom Studio's legal representatives and vicarious agents if claims are asserted directly against them.

(4) To the extent that Miom Studio's liability is excluded or limited in these Terms and Conditions, this shall also apply to the personal liability for damages of Miom Studio's employees, staff, representatives, and vicarious agents.

(5) The provisions of the Product Liability Act shall remain unaffected.

Section 9 Gift Vouchers
(1) Gift vouchers with a predetermined value can be purchased in the online shop. Gift vouchers can only be redeemed to pay for goods and services in the Miom Studio online shop. They cannot be used to purchase other gift vouchers.

(2) Cash payment of the voucher value or any remaining balance, as well as interest on the balance, is excluded, unless mandatory legal provisions stipulate otherwise.

(3) Gift vouchers are valid beyond the statutory limitation period. The claim arising from the voucher expires according to statutory provisions, generally at the end of the third calendar year following the year of purchase (Sections 195, 199 of the German Civil Code). Once the limitation period has expired, the voucher can no longer be redeemed.

(4) If the balance of a gift voucher is insufficient to cover an order, the difference can be paid using the payment methods offered in the online shop.

(5) If an order paid for in whole or in part with a gift voucher is effectively canceled or reversed for any other reason, the corresponding amount will be refunded by crediting the gift voucher used. The voucher value will not be paid out in cash.

(6) Gift vouchers are transferable. The seller may fulfill their obligations by making payment to the current holder, provided they have no knowledge or grossly negligent ignorance of the current holder's lack of entitlement, legal incapacity, or lack of authority to act on behalf of another.

(7) There is no entitlement to a replacement gift voucher in the event of loss, theft, or misuse.

Section 10 Copyrights
The designs, instructions, patterns, graphics, layouts, images, and templates of the offered goods and the Miom Studio website are copyrighted property of Miom Studio. They may not be used for any purpose other than the contractual use without the consent of Miom Studio. In particular, the customer may not publish or sell the instructions.

Section 11 Final Provisions
(1) Contracts between Miom Studio and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the customer is a merchant, the place of jurisdiction for all disputes arising from contractual relationships between the customer and Miom Studio is Cologne.
